These Terms of Service ("Terms") govern your access to and use of the BuildSight platform, operated by BuildSight Inc., a corporation organized under the laws of Delaware, USA.

By accessing or using BuildSight, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Service Description BuildSight provides AI-powered construction site monitoring, including computer vision progress tracking, safety violation detection, schedule delay prediction, and automated reporting. The platform processes imagery from drones, fixed cameras, and mobile uploads.

2. Account Responsibilities You are responsible for maintaining the confidentiality of your account credentials. You agree to notify BuildSight immediately of any unauthorized use. You are responsible for all activity under your account.

3. Acceptable Use You may not use BuildSight to: (a) violate any applicable law or regulation; (b) upload content you do not have rights to; (c) attempt to reverse-engineer, decompile, or disassemble the platform; (d) interfere with the platform's operation or security.

4. Data Ownership You retain ownership of all imagery, blueprints, BIM models, and project data you upload to BuildSight. We do not claim ownership of your content. We process your data solely to provide the services described in your subscription.

5. Limitation of Liability BuildSight Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

6. Termination Either party may terminate the agreement with 30 days written notice. Upon termination, your data will be available for export for 90 days, after which it will be permanently deleted.

BuildSight Inc. ("we," "us," "our") is committed to protecting the privacy of our users. This Privacy Policy explains how we collect, use, and safeguard your information.

1. Information We Collect - Account information: name, email, company, role - Project data: imagery, blueprints, BIM models, schedule data - Usage data: feature usage, login times, device information - Camera and drone metadata: timestamps, GPS coordinates, device identifiers

2. How We Use Your Information We use your information to: (a) provide and improve the BuildSight platform; (b) generate AI-powered analysis, reports, and predictions; (c) communicate service updates and support; (d) ensure platform security and prevent abuse.

3. Data Processing All imagery and project data is processed using our proprietary AI models. Data is processed in secure cloud environments and is never shared across customer accounts. Edge processing occurs on-site for low-bandwidth deployments.

4. Data Security All data is encrypted in transit (TLS 1.3) and at rest (AES-256). BuildSight is SOC 2 Type II certified. We conduct regular penetration testing and security audits. Enterprise clients may request dedicated cloud environments.

5. Data Retention Project data is retained for the duration of your subscription plus 90 days. You may request data export or deletion at any time by contacting privacy@buildsight.pro.

6. Your Rights You have the right to: access your data, correct inaccuracies, request deletion, export your data, and object to processing. Contact privacy@buildsight.pro to exercise these rights.

BuildSight takes the security of your construction data seriously. Our security program is designed to protect sensitive project information, imagery, and AI-generated insights.

1. Infrastructure Security - SOC 2 Type II certified - AES-256 encryption at rest - TLS 1.3 encryption in transit - Dedicated cloud environments available for Enterprise clients - Regular penetration testing by third-party firms

2. Application Security - Role-based access control (RBAC) - Single Sign-On (SSO) support for Enterprise - Multi-factor authentication available - Session management with automatic timeout - Audit logging for all data access

3. Data Isolation Project data is strictly isolated between customer accounts. No cross-account data sharing occurs. AI models are trained on anonymized, aggregated data only — never on individual customer projects without explicit consent.

4. Edge Processing Security For sites using edge processing (low-bandwidth mode), data is processed locally and encrypted before transmission. Edge devices are hardened and remotely managed.

5. Incident Response BuildSight Inc. maintains a documented incident response plan. In the event of a security incident, affected customers will be notified within 72 hours.
